Terms of Service

Welcome to MuseMark. These Terms of Service (the "Terms") are a binding agreement between you and Dreamsmyth LLC, a Pennsylvania limited liability company with a principal place of business in Allentown, PA, USA ("MuseMark", "we", "us", or "our"). By creating an account, purchasing a tag, or otherwise using the website at musemark.uk or any related services (together, the "Service"), you agree to these Terms. If you do not agree, do not use the Service.

1. Definitions

  • MuseMark — the website at musemark.uk and related services operated by Dreamsmyth LLC.
  • Tag (also referred to as a "Token" or "Medallion") — a physical metal item engraved with a unique QR code that links to a page hosted on the Service.
  • Profile — the page created by a User and associated with one or more Tags. Users may create Personal, Object, or Business profiles.
  • User — any person who creates an account on the Service.
  • Owner — the User who has activated and currently controls a given Tag.
  • Subscription — the paid plan that allows a User to create and host Profiles on the Service.

2. Eligibility

You must be at least eighteen (18) years of age to use the Service. By using the Service you represent that you (a) are 18 or older, (b) have the legal capacity to enter into a binding contract in your jurisdiction, and (c) are not a person with whom U.S. persons are prohibited from doing business under applicable sanctions or export-control laws, and are not located in a country subject to a comprehensive U.S. embargo. The Service is not directed at minors and we do not knowingly allow minors to register. If we learn that a User is under 18, we will terminate the account and delete associated data.

3. Account Registration

You must provide accurate, current, and complete information when registering, and keep that information up to date. One person may hold one account; creating multiple accounts to evade suspension, chargeback limits, or other controls is prohibited. You may not impersonate another person or misrepresent your affiliation with anyone. You are responsible for safeguarding your password and for all activity that occurs under your account. Notify us immediately at support@musemark.uk if you believe your account has been accessed without your authorization.

4. Subscription Terms

The standard consumer Profile Subscription currently costs twelve U.S. dollars ($12.00 USD) every three (3) months, billed quarterly (advertised as four U.S. dollars ($4.00 USD) per month), and entitles the User to create and host an unlimited number of Profiles while the Subscription is active. A Maker Subscription, intended for crafters, manufacturers, and small businesses, is offered at the User's choice of fifteen U.S. dollars ($15.00 USD) per month, billed monthly, or one hundred fifty U.S. dollars ($150.00 USD) per year, billed annually, and entitles the User to additional features including dual-purpose tags, claim metrics, and bulk tag pricing. Subscriptions renew automatically at the posted rate at the start of each new billing period unless you cancel before that date. You may cancel at any time from your dashboard; cancellation stops future renewals and takes effect at the end of the current paid period, during which you retain access. Subscription fees are not refundable on a pro-rata basis for unused time. Refund rights are governed by our Refund Policy.

We may change Subscription pricing. If we do, we will give you at least thirty (30) days' notice before the change takes effect on your account, and you may cancel before then to avoid being charged the new price.

5. Physical Tags

Physical Tags are sold as one-time purchases, separately from the Subscription, in quantities including Single, 3-pack, 5-pack, and 10-pack. Ownership of the physical tag transfers to you on delivery, subject to the Refund Policy. The unique identifier engraved on a Tag is permanently bound to the User who first activates it; thereafter, only that User (or a User to whom the Tag is voluntarily transferred through the dashboard) may control the linked Profile. Lost, stolen, or damaged Tags cannot be remotely disabled without the account holder's authenticated request. A Tag only functions while a valid Subscription is active on the linked account; inactive-subscription Tags will display a placeholder page instead of Profile content.

6. Acceptable Use

MuseMark is a general-purpose tag and profile service. You may use your Profile to share whatever information is useful for the Tag you own, subject to the rules below.

Permitted content

  • Information about you, an item you own, or a business you operate.
  • Contact details, emergency information, provenance and maintenance history, product information, and similar material that fits the purpose of the Tag.
  • Adult content is permitted only where all depicted individuals are verified consenting adults and the content complies with all applicable laws and the rules below.

Prohibited content and conduct

  • Any content that sexualizes, depicts, or involves minors, including child sexual abuse material (CSAM). This is a zero-tolerance category and may result in referral to NCMEC and law enforcement.
  • Non-consensual content, including imagery or depictions of actual non-consensual acts, "revenge" content, hidden-camera material, or content posted without the subject's consent.
  • Content depicting real violence, serious bodily injury, self-harm, or the promotion of suicide.
  • Impersonation of another person, whether by name, likeness, or claimed credentials.
  • Doxxing or the publication of another person's private information without their consent.
  • Any activity that violates applicable law, including the sale of regulated substances, human trafficking, solicitation where illegal, and bestiality.
  • Spam, mass unsolicited messaging, phishing, malware, or scraping of the Service.
  • Harassment, threats, hate speech targeting protected classes, or coordinated abuse.
  • Attempts to gain unauthorized access to other accounts, the platform, or other users' data.

We may remove content and suspend or terminate accounts that violate these rules, with or without notice.

7. User Content License

You retain ownership of the content you upload to your Profiles ("User Content"). You grant MuseMark a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, transmit, and distribute your User Content solely for the purpose of operating and providing the Service (including making your Profile visible to anyone who scans your Token or visits its URL, and creating backups and derivative display copies such as thumbnails). This license ends when you delete the content or your account, except that we may retain residual backups for a reasonable period and may retain content where required to comply with law or resolve disputes.

You represent that you own or have the rights to all User Content you upload, that it does not infringe anyone else's rights, and that every identifiable person depicted is a consenting adult.

8. DMCA and Intellectual Property Policy

We respect intellectual property rights and expect Users to do the same. If you believe content on the Service infringes your copyright, send a notice under the Digital Millennium Copyright Act (17 U.S.C. ยง 512) to our designated agent at abuse@musemark.uk. Your notice must include:

  1. A physical or electronic signature of the copyright owner or authorized agent.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. The URL or other specific location of the allegedly infringing material.
  4. Your contact information (name, address, phone, email).
  5. A statement that you have a good-faith belief that the use is not authorized.
  6. A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner's behalf.

If your content was removed in response to a DMCA notice and you believe the removal was wrongful, you may submit a counter-notice with the corresponding statutory elements to the same address. We terminate the accounts of Users found to be repeat infringers.

9. Termination

You may delete your account at any time through your dashboard. On deletion, your Profiles become inaccessible, Tags linked to your account become unlinked, and your personal data is handled in accordance with our Privacy Policy.

We may suspend or terminate your account, remove content, or refuse service, with or without notice, if you violate these Terms, if continued service would expose us or other Users to legal or security risk, or if required by law. Financial consequences of termination are governed by our Refund Policy.

10. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that Profile content will remain available or be accurate. Your use of the Service is at your sole risk.

11. Limitation of Liability

To the maximum extent permitted by law, Dreamsmyth LLC and its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages. Our aggregate liability for all claims arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty U.S. dollars ($50.00 USD).

12. Indemnification

You agree to defend, indemnify, and hold harmless Dreamsmyth LLC and its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your User Content, (b) your use of the Service, (c) your violation of these Terms, (d) your violation of any law or the rights of a third party, or (e) your misrepresentation regarding consent, age, or authority to post content.

13. Governing Law and Jurisdiction

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules. Subject to Section 14 (Arbitration), the state and federal courts sitting in Lehigh County, Pennsylvania have exclusive jurisdiction over any dispute that is not subject to arbitration, and you consent to personal jurisdiction and venue in those courts.

14. Binding Arbitration and Class Action Waiver

Please read this section carefully. It affects your legal rights.

Except for claims for injunctive relief to protect intellectual property or account security, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Lehigh County, Pennsylvania, or, at your election, by telephone or video conference. Judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and MuseMark each agree that disputes will be resolved only on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.

30-day opt-out. You may opt out of this arbitration agreement by sending written notice to hello@musemark.uk within thirty (30) days of first accepting these Terms. Your notice must include your full name, the email address associated with your account, and a clear statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will give you at least thirty (30) days' advance notice by email to the address associated with your account or by an in-service banner. Non-material changes take effect on posting. Continued use of the Service after the effective date of a change constitutes acceptance of the updated Terms. If you do not agree to a change, your remedy is to stop using the Service and cancel your Subscription before the change takes effect.

16. Miscellaneous

These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and MuseMark regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be sent to the email address on your account.

17. Medical Information

If you choose to add medical information to your profile, that information is publicly accessible to anyone who scans your tag. MuseMark does not encrypt, restrict, or verify access to medical data. The medical section is intentionally designed for use by emergency responders, who can scan a tag and view critical information when you cannot speak for yourself.

By providing medical information, you accept all risks of public disclosure, including but not limited to:

  • The information may be read by anyone who scans your tag.
  • The information is not verified by MuseMark and is presented as-provided.
  • We make no warranty regarding the accuracy, completeness, or fitness of the information for any medical decision.
  • You are responsible for keeping the information current.

Each version of the medical disclosure language is recorded with your account at the time you accept it. We retain this record so that any changes to the disclosure wording in the future do not retroactively change what you originally agreed to.

You may remove your medical information from your profile at any time. Removing the medical information also clears the consent record.

18. Lost Items and Rewards

You may flip a tag into return mode and add a custom message, optional reward, and contact info. The banner that appears on your public profile is provided as a courtesy. Any reward you offer is between you and the finder.

MuseMark does not process, hold, escrow, verify, mediate, or guarantee rewards offered through this feature. We are not a payment intermediary or arbitrator for reward arrangements. If a finder returns your item and you do not pay the reward you advertised, MuseMark has no obligation to enforce that arrangement, and you assume all risks of disputes that arise from it.

You are responsible for the accuracy of any contact information or reward amount you publish. Anything you publish in return mode is publicly visible to anyone who scans the tag.
